What data do we collect?
Turkington Psychiatry Limited collects the following data:

Special category personal information about your health, including medical records and any information disclosed to us by you or your representative or medical professionals
Information about Court proceedings relating to you and any materials provided by you, your representative, any other party to the proceedings or the Court, this could include special category data such as offences that you may have been charged with

How do we collect your data?
You or your representative usually directly provide Turkington Psychiatry Limited with most of the data we collect, however in some instances data may be collected from the Court or other parties in the proceedings. Information may also be obtained from your GP or any hospital that holds relevant records. We collect data and process data when you:

How will we use your data?
Turkington Psychiatry Limited collects your data so that we can assess your mental health and provide comprehensive independent expert psychiatric reports to the Court.
We will share your data with your representative, the Court and any other parties to the Court proceedings. In circumstances where it is believed to be necessary for the purposes of safeguarding yourself or others, your information may be shared with relevant authorities such as the police or health services.
What is the legal basis for us processing your data?
The General Data Protection Regulation requires specific conditions to be met to ensure that the processing of personal data is lawful. The relevant conditions that we rely upon in processing your data are set out below:
General Data Protection Regulation Article 6 (1) (e) Public task: the processing is necessary to perform a task in the public interest or for official functions, and the task or function has a clear basis in law.
The processing is necessary for the purpose of supplying independent expert reports to the Court, the function has a clear basis in law and is governed by Part 35 of the Civil Procedure Rules, Part 25 of the Family Procedure Rules and Part 19 of the Criminal Procedure Rules.
How do we store your data?
Turkington Psychiatry Limited securely stores your data on appropriately password protected and locked away computers. Any data held psychically is stored securely in appropriately locked cabinets, in locked premises.
We will keep your data for a period of 6 years. Once this time period has expired, we will delete your data from any IT systems and ensure safe and secure disposal of any hard copy data.
What are your data protection rights?
You are entitled to the following:
The right to access – You have the right to request copies of your personal data from us
The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request we complete the information you believe is incomplete.
The right to erasure – You have the right to request that we erase your personal data, under certain conditions.
The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
The right to object to processing – You have the right to object to the processing of your personal data, under certain conditions.
